--- documentId: GUOSMM-C-2026-031 series: C title: "DBIS Wholesale Settlement Boundary and Eligible Participant Regulation" publishedAt: "2026-07-24T12:15:00Z" effectiveAt: "2026-07-24T12:15:00Z" publicationTimingStatus: proposed_until_counsel_and_signature --- # OFFICIAL GAZETTE OF THE SOVEREIGN MILITARY ORDER OF MALTA (GUOSMM) **Document ID:** `GUOSMM-C-2026-031` # DBIS Wholesale Settlement Boundary and Eligible Participant Regulation ## Article 1 - Purpose 1.1 This Regulation defines the wholesale-only perimeter for DBIS settlement accounts, participant eligibility, and public-claim boundaries. 1.2 This Regulation does not grant external banking, payment, custody, securities, insurance, or settlement-system authorization in any respondent jurisdiction without separately applicable authority. 1.3 The `publishedAt` and `effectiveAt` values are proposed draft timestamps until counsel approval, production signature, and publication owner release occur. ## Article 2 - DBIS Role 2.1 DBIS is a governmental wholesale settlement institution. 2.2 DBIS is not a retail bank, savings institution, consumer financial institution, public depository institution, general commercial deposit-taking bank, BIS equivalent, IMF equivalent, national central bank, or national banking regulator. 2.3 DBIS settlement accounts are limited-purpose settlement accounts and not general-purpose bank accounts. ## Article 3 - Eligible Participants 3.1 Direct participants are limited to: - central banks; - monetary authorities; - governmental treasuries; - qualifying international financial entities or institutions. 3.2 Additional participant classes require express OMNL approval, express legal authorization, and jurisdictional perimeter review. ## Article 4 - Eligibility Tests 4.1 An applicant participant must satisfy all applicable tests: - sovereign, governmental, central-bank, monetary-authority, treasury, clearing-system, multilateral, or regulated institutional status; - settlement, clearing, reserve, reconciliation, or finality account purpose; - no public retail onboarding path; - protected-name, banking, payment, settlement, custody, securities, foreign-bank, and systemic-infrastructure perimeter classification; - sanctions, AML/CFT, beneficial-ownership, and travel-rule controls. ## Article 5 - Prohibited Claims 5.1 No public material may represent DBIS publication alone as correspondent-banking access, admitted-insurance access, securities-market access, deposit insurance, legal tender, public account availability, or respondent-jurisdiction authorization. 5.2 DBIS may only state settlement capacity within the published Order framework, participant agreements, and applicable jurisdictional approvals. ## Article 6 - Legal Master Document Controls 6.1 DBIS participant and settlement claims depend on DBIS establishment, juridical-personality classification, delegated-powers schedule, reserved-powers schedule, officer authority, and continuing-existence controls. 6.2 DBIS cannot use 1113, 1530, or another parent historical date as its own formation date unless an authoritative DBIS instrument proves that date. 6.3 Domestic transactability filings do not authorize deposits, insured deposits, money transmission, e-money, payment services, trust powers, custody, securities activity, exchange operation, consumer credit, foreign-bank branch activity, or protected banking terminology where permission is required. ## Article 7 - Exception Escalation 7.1 Any participant class outside Article 3.1 requires an express written exception memo approved by OMNL and recorded in the jurisdictional perimeter review set before onboarding or public mention. 7.2 The exception path must name the affected class, the approving authority, the governing jurisdiction, and any counsel condition attached to the approval. 7.3 Until an exception memo exists, no additional participant class is authorized by implication. --- *Signing authority: Sovereign M … [truncated — download body.md for full text]
