Delegation of International Humanitarian, Technical, and Development Powers

Section 1 — Purpose and authority

1.1 This Instrument states the Order-law basis on which the Sovereign Military Order of Malta may constitute, empower, and supervise chartered agencies, ministries, departments, offices, programmes, and instrumental bodies serving humanitarian, educational, technical, medical, identity-support, telecommunications, crisis-response, employment, and development purposes.

1.2 This Instrument is issued in reliance on the Order's established international legal personality, diplomatic relations, Permanent Observer participation in the United Nations system, and international cooperation practice in support of the Order's humanitarian mission.

1.3 This Instrument delegates powers internally under Order law. It does not declare any subordinate body to be an independent State, nor does it by itself create immunity, recognition, or regulatory exemption against any respondent jurisdiction.

Section 2 — Delegated bodies

2.1 Bodies operating under this Instrument may include chartered agencies, cooperative bodies, licensed delegates, programme vehicles, and subordinate administrative organs recognized in GUOSMM or SHOSJJ registry records.

2.2 As of this draft, the principal bodies expressly contemplated include:

  • Sankofa, as sovereign technology provider and cloud-governance body
  • PanTel, as multinational telecom cooperative under PANDA
  • Complete Credential, as credential workflow and verification platform operator
  • SMOA, as the order and authenticated-copy continuity lane
  • 2.3 Additional bodies may be admitted by later GUOSMM publication, registry designation, or express delegation instrument.

    Section 3 — Liberally construed delegated powers

    3.1 Each delegated body shall possess all powers reasonably necessary, incidental, conducive, or convenient to carry out its chartered purposes.

    3.2 Such powers may include the power to:

  • contract and form lawful operational arrangements
  • employ, train, appoint, and supervise personnel and officers
  • operate programmes, platforms, clinics, schools, portals, registries, networks, communications systems, and technical infrastructure
  • provide humanitarian relief, education, training, employment, project administration, and quality-of-life programmes
  • collect, review, maintain, verify, and present records and evidence subject to applicable privacy, confidentiality, and records rules
  • hold, administer, and disburse funds, grants, equipment, property, and project resources for chartered purposes
  • issue internal administrative acts, programme standards, operating rules, eligibility criteria, and technical controls
  • enter into memoranda, service arrangements, training partnerships, implementation arrangements, and other lawful cooperative instruments
  • engage governments, international organizations, civil-society bodies, counterpart institutions, and private actors for mission-aligned purposes
  • 3.3 These powers shall be construed broadly in favor of operational effectiveness, provided that no construction shall be read to authorize a prohibited claim or an act unlawful in the jurisdiction concerned.

    Section 4 — International humanitarian and development footing

    4.1 Delegated bodies may undertake external-facing engagement in support of the Order's humanitarian and development mission, including programmes directed to poverty reduction, education, crisis response, health-support, identity-support, infrastructure uplift, employment, and community welfare.

    4.2 Mission alignment with multilateral development and humanitarian objectives, including United Nations Sustainable Development Goals, may be stated where accurate and relevant.

    4.3 No reference to multilateral objectives, observer participation, diplomacy, or cooperation practice shall be construed as creating blanket authority to disregard host-state law, licensing, or regulatory requirements.

    Section 5 — Diplomatic and cooperation footing

    5.1 Delegated bodies may act externally under the diplomatic and cooperation footing of the Order where:

  • the body acts within its chartered mission
  • the relevant Order authority chain is identified
  • the external act is lawful in the jurisdiction concerned
  • any required host-state filing, authorization, consent, or counsel gate is satisfied
  • 5.2 Delegated bodies do not automatically inherit every treaty right, privilege, immunity, or recognition position that may apply to the Order itself.

    5.3 Where a treaty, cooperation agreement, host-country arrangement, diplomatic exchange, or respondent-jurisdiction filing expressly extends operational standing to a delegated body, that extension shall be documented and cross-referenced in GUOSMM or the relevant registry.

    Section 6 — Host-law compliance and savings

    6.1 All external acts under this Instrument shall be undertaken subject to applicable law, recognition requirements, licensing regimes, labor rules, privacy and data-protection rules, telecom rules, identity rules, health rules, sanctions, export controls, customs, and anti-corruption requirements in the jurisdictions concerned.

    6.2 Nothing in this Instrument shall be construed to authorize:

  • independent-state status for a subordinate body
  • nation-state passport authority in a subordinate body's own name
  • telecom spectrum entitlement without local authority
  • central bank, EMI, payment-institution, or settlement authority except where separately chartered
  • exemption from taxation, levy, registration, filing, or supervision absent an applicable instrument or law
  • 6.3 If any clause of this Instrument is read more broadly than applicable law permits in a given jurisdiction, that clause shall be applied to the maximum lawful extent without invalidating the remainder.

    Section 7 — Supervision, subdelegation, and records

    7.1 Each delegated body shall maintain current records of:

  • charter authority
  • responsible officers
  • operational programmes
  • respondent-jurisdiction dependencies
  • required counsel or regulator gates
  • non-claims relied upon in public-facing materials
  • 7.2 Subdelegation is permitted only to the extent stated in the body's charter, operating rules, or later GUOSMM publication.

    7.3 Each delegated body shall preserve a public or internal record sufficient to distinguish:

  • Order-law internal authority
  • external legal footing
  • pending legal or regulatory dependencies
  • Section 8 — Construction

    8.1 This Instrument shall be construed to maximize lawful operational capacity in service of the Order's humanitarian, educational, technical, and development mission while preserving accuracy as to external legal effect.

    8.2 Where a question arises between a narrow and a broader lawful construction, the broader lawful construction shall govern unless another signed instrument expressly limits it.
